Tipped Minimum Wage in Chicago (2026)
Chicago pays some of the highest tipped wages in the country — and it is mid-way through the most consequential change in the industry: a scheduled phase-out of the tip credit entirely. As of July 1, 2026 the full city minimum is $17.05 and the tipped rate is $12.96 per chicago.gov. Here is how the credit, the top-up and the phase-out schedule actually work.

How Chicago tipped pay works
Chicago sets its own minimum wage under its ordinance: $17.05 an hour as of July 1, 2026, for employers with 4 or more employees, with the rate adjusting every July 1 by the Consumer Price Index capped at 2.5%. Tipped workers — servers, bartenders, bussers who customarily receive tips — have a tipped minimum wage of $12.96. That leaves a tip credit of $4.09 per hour, which is 24% of the full minimum: the employer may pay $12.96 in cash only if tips cover the remaining $4.09, and if wages plus tips fall short of $17.05 for any hour, the employer must make up the difference. Illinois state law works the same way with lower numbers — $15.00 full, $9.00 tipped — and the higher Chicago figures win inside city limits (see our Illinois tipped minimum wage breakdown).
The workweek math: 30 hours at $12.96 is $388.80 in cash wages, and the weekly floor is 30 × $17.05 = $511.50. Keep $260 in tips and you finish at $648.80 — $21.63 an hour effective, no top-up owed. Keep only $90 and cash plus tips is $478.80, short by $32.70, which must appear on the check as make-up pay. The server paycheck calculator runs this check on your own hours automatically.
Chicago's ordinance also sets a separate $18.50 minimum as of July 1, 2026 for workers on city contracts and concessionaire agreements — a tier that applies at O'Hare and Midway concessions and other city work, not at ordinary restaurants.
The tip credit phase-out, and the 2026 pause
Chicago's One Fair Wage ordinance, passed in 2023, was built as a five-year phase-out of the tip credit beginning July 1, 2024, with tipped workers reaching the full minimum wage by July 1, 2028. Then the schedule changed: on May 20, 2026, the City Council voted to pause the phase-out for two years, according to coverage of the vote. That means the scheduled parity steps for July 1, 2026 and July 1, 2027 were skipped — the tipped rate rises only with the annual inflation adjustment (to $12.96 this July) — and full parity is now reported for 2028 for larger employers, later for smaller ones. For servers, the practical reading: the gap between $12.96 and $17.05 no longer closes on the old timetable, and the schedule could move again. Confirm the current step before making a multi-year plan.
Chicago vs. Illinois vs. the federal rule
| Rule | Chicago (2026) | Illinois (2026) | Federal |
|---|---|---|---|
| Full minimum wage | $17.05 (July 1, 2026) | $15.00 | $7.25 |
| Tipped cash wage | $12.96 | $9.00 (60% of minimum) | $2.13 |
| Maximum tip credit | $4.09 (24% of minimum) | $6.00 | $5.12 |
| Top-up when tips fall short | Required, to $17.05 | Required, to $15.00 | Required, to $7.25 |
| Overtime basis | Full minimum — OT cash rate $21.49 | Full minimum — OT cash rate $16.50 | Full minimum — OT cash rate $5.76 |
| Adjustment | Every July 1, CPI capped at 2.5% | State schedule | None since 2009 |
The table is the whole argument for working inside city limits: the same 30-hour week carries a $511.50 floor in Chicago versus $450.00 under the state tipped rule and $217.50 federally. Geography is worth $61.50 a week before a single tip is counted.

What Chicago servers should watch
The phase-out schedule itself. The May 2026 pause is the single biggest variable in a Chicago serving career. The $4.09 credit was scheduled to shrink toward zero; today it holds at 24% of the minimum while the city studies next steps. Track the chicago.gov minimum wage page before assuming any future parity date.
The top-up, checked weekly. Slow weeks are when the $17.05 floor is supposed to catch you. Track hours and kept tips per workweek; anything averaging under $17.05 triggers make-up pay. A strong Saturday never subsidizes a dead Tuesday under the same week's math.
Overtime on the full minimum. Tipped overtime is computed on $17.05, not $12.96: the correct OT cash rate is $12.96 + half of $17.05 = $21.49 an hour, plus tips. An employer paying time-and-a-half on the cash wage ($19.44) is shorting you $2.05 on every overtime hour — the overtime calculator prices your exact week.
The city line. Work in Chicago and the $17.05/$12.96 rates apply; cross into suburban Cook County and lower county ordinance rates govern instead. Servers who work shifts on both sides of the line should log where each hour happened — the two ordinances do not mix on one check.
Your real number. A $12.96 base with $22 an hour in tips is a $34.96 job in disguise. Compute effective hourly — wages plus kept tips, divided by hours — before comparing this job to any other. FAQ
What is the tipped minimum wage in Chicago in 2026?
$12.96 per hour as of July 1, 2026, for employers with 4 or more employees. If wages plus tips do not reach the full $17.05 city minimum, the employer must make up the difference (per chicago.gov).
Is Chicago still eliminating the tip credit?
Not on the original schedule. In May 2026 the City Council paused the One Fair Wage phase-out for two years, skipping the July 1, 2026 and July 1, 2027 steps toward parity. The tipped rate now rises only with the annual inflation adjustment, with full parity reported as delayed until 2028 for larger employers. Verify the current schedule with the city.
What happens if my tips don't reach $17.05 an hour in Chicago?
The employer must make up the difference so every hour pays at least the full $17.05 minimum. The check is made on wages plus tips; the shortfall appears on your check as make-up pay.
How is overtime calculated for tipped employees in Chicago?
Overtime rides on the full minimum, not the $12.96 tipped wage. The OT cash rate equals the tipped wage plus half the full minimum: $12.96 + $8.53 = $21.49 per overtime hour, plus tips.
Does the $17.05 Chicago minimum apply in the suburbs?
No. The Chicago rate applies within city limits to employers with 4 or more employees. Suburban Cook County sets its own, lower ordinance rates — verify the current suburban figures with the county before comparing offers.
How do I calculate my real weekly pay in Chicago?
Tipped wage × hours, plus the tips you kept, checked against the $17.05-per-hour weekly floor with the top-up rule. A paycheck calculator that runs that check automatically is the fastest way.
